When you set out to purchase an aircraft you want to make sure that you have all the i's dotted and the t's crossed. In other words, there are certain aspects of aviation law that you need to know before you purchase an airplane. How you purchase the airplane, where you take delivery of the aircraft and the method which you operate it will all affect how both the FAA and the IRS treat your aircraft purchase.
The first thing you need to do is hire an aviation attorney. A competent aviation lawyer will be conversant with the Federal Aviation Administration rules on aircraft ownership and operation, as well as the tax consequences that will be relevant to your purchase.
In addition, you need to be aware of the liability exposure you take on when you purchase and/or operate an aircraft. This will affect how you title the aircraft, how you insure the aircraft and the FAA rules under which you operate your aircraft.
Many people choose to title their aircraft in a corporation, LLC or partnership, each of which has different consequences depending upon your circumstances. Throughout the period of aircraft ownership you will be exposed to a number of contracts. For example, when you take your aircraft to a maintenance facility, look over the service order form carefully before signing. Very often there is language on these forms limiting their liability for your aircraft while it is in the care, custody and control.
If you find this is the case contact your insurance agent and make sure you are not negating some coverage under your policy by signing such an agreement. Generally speaking the insurance company will make an allowance for this kind of contract, but always make sure before you find yourself dealing with an aviation lawyer over a loss.
